Types of Student Conduct Hearings

Administrative Hearing

An administrative hearing is an informal process handled administratively by the Assistant Dean of Students. Administrative hearings typically consist of an informal presentation of evidence to the respondent, a conversation of the incident, and a determination of responsibility (the student is found responsible or not responsible for violating the Student Code of Conduct). If a student is found responsible, sanctions may be applied at the discretion of the Assistant Dean of Students.

Conduct Board Hearing

Conduct board hearings are utilized for serious cases of student misconduct and are initiated at the discretion of the Assistant Dean of Students. The Conduct Board is comprised of a panel of two faculty, two staff, and two students. Members of this panel, as well as one alternate for each group, will be selected on an annual basis. Both the respondent and the party bringing the violation forward will have the opportunity to present their sides. If either party wishes to present witnesses to corroborate their information, the names of the witnesses and their statements should be sent to the Assistant Dean of Students via email five business days prior to the hearing. Witnesses will be invited to attend the hearing by the Assistant Dean of Students and will be given an opportunity to share their information at the hearing. Once all parties and witnesses are heard, the Board will deliberate and render a decision. If the student is found responsible, the Board will also suggest possible sanctions for the student that will be approved by the Assistant Dean of Students.

In both types of conduct hearings, the hearings may be held in-person or virtually at the discretion of the Assistant Dean of Students.

In both hearing types, failure of the respondent to appear at the appointed hearing/meeting will be construed as obstructing the judicial procedure and may be viewed as an admission of responsibility.

The standard of proof required for finding that policy has been violated will be the preponderance of the evidence.

Reports of Alleged Title IX Policy Violations

Reports of alleged Title IX Policy violations will adhere to the processes and procedures described in the Title IX/Sexual Misconduct Policy.
