Conduct Board Hearing Process

Prior to the hearing, all members of the Board along with the complainant and the respondent will receive a copy of the initial report of the alleged violation and all other materials collected by the Assistant Dean of Students in their investigation of the alleged violation.

Before the hearing begins, a moderator will be selected to run the hearing and a secretary will be appointed to take minutes and to make sure that the hearing is being recorded via a digital recording device.

Hearings will follow the following procedures:

  1. Rules of the hearing will be read.
  2. The panel will be introduced.
  3. The alleged violations will be read.
  4. The student will admit or deny violating College policy.
    1. If the student admits policy violations, the Board will proceed to determine sanctions to be recommended to the Assistant Dean of Students for final determination.
    2. If the student denies policy violations, the Board will hear evidence from the complainant, the respondent, and any witnesses.

If the policy violation is denied by the respondent, the Board will first hear from the parties in this order: complainant, respondent, complainant witnesses, and respondent witnesses.

The standard of proof required for finding that policy has been violated will be the preponderance of the evidence.

Deliberation

Once all parties and witnesses have been heard and all information about the alleged violation has been shared, the complainant, respondent, and any witnesses will be excused so the Board may deliberate, weigh the merits of the information presented, and make a determination. The respondent will be asked to remain in the lobby area or closest student lounge during this time.

Upon conclusion of deliberation, the respondent will be asked to come back into the room and told the Board’s decision.
