Witnesses

Updated on

Both the respondent and the party bringing the violation forward will have the opportunity to present their sides. If either party wishes to present witnesses to corroborate their information, the names of the witnesses and their statements should be sent to the Assistant Dean of Students via email five business days prior to the hearing. Witnesses will be invited to attend the hearing by the Assistant Dean of Students and will be given an opportunity to share their information at the hearing. Pertinent records, exhibits, and written statements may be accepted as evidence for consideration by the Board, at the discretion of the Assistant Dean of Students.

In most cases, the respondent will remain in the room during all witness accounts. However, the Assistant Dean of Students may make the determination as to whether or not the respondent can be present when adverse witnesses give their accounts. The Assistant Dean of Students may also elect to have all witnesses present for the entire hearing or to have them come before the Board sequentially.

All questions will go through the members of the Conduct Board. If either party has a question for a witness, they must ask the question to the moderator, who will in turn determine if the question is appropriate and will pose all questions to witnesses.

Important Note: Retaliation by any party toward others involved in the adjudication of a violation, including witnesses, is a violation of the Student Code of Conduct.
